By downloading, accessing, or using the Toto mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Toto is a mental health and wellness application that provides educational content, tools, and resources based on Acceptance and Commitment Therapy (ACT) principles to help users manage anxiety and OCD symptoms. The App includes:

• A 7-day free educational program
• Mood tracking and journaling features
• Exposure logging tools
• Audio content
• Optional premium features including extended content and AI chat support

3. Medical Disclaimer

IMPORTANT: Toto is not a substitute for professional medical advice, diagnosis, or treatment. The App provides educational and self-help tools but does not provide medical or therapeutic services. Always seek the advice of qualified health providers with questions regarding medical conditions.

If you are experiencing a mental health crisis or emergency, immediately contact emergency services (911 in the US) or a crisis helpline such as the 988 Suicide and Crisis Lifeline.

4. User Eligibility

You must be at least 13 years old to use this App. If you are under 18, you must have permission from a parent or guardian. By using the App, you represent that you meet these requirements.

5. User Account and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to:

• Provide accurate and complete information
• Keep your login credentials secure
• Notify us immediately of any unauthorized access
• Use the App only for lawful purposes

6. Subscription and Payment Terms

Toto offers a free 7-day program with optional premium subscription features. Premium subscriptions are billed through the Apple App Store and are subject to their payment terms and policies.

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage or cancel subscriptions in your App Store account settings
• No refunds are provided for unused portions of subscription periods

7. User Content and Data

You retain ownership of content you create in the App (journal entries, mood logs, etc.). By using the App, you grant us a limited license to process and store this content to provide the service. We will handle your data in accordance with our Privacy Policy.

8. Prohibited Uses

You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Use the App to harm, harass, or impersonate others
• Share, sell, or distribute your account access

9. Intellectual Property

The App, including all content, features, and functionality, is owned by Toto and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

10. Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms or for any other reason. Upon termination, your right to use the App will immediately cease.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms in the App or on this website. Continued use of the App after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of the United States and the state in which our company is registered, without regard to conflict of law provisions.
